What is the FMCSA Drug and Alcohol Clearinghouse?

The Clearinghouse is a secure online database that will give employers, the Federal Motor Carrier Safety Administration (FMCSA), State Driver Licensing Agencies (SDLAs), and State law enforcement personnel real-time information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations.

The Clearinghouse will contain records of violations of drug and alcohol prohibitions in 49 CFR Part 382, Subpart B, including positive drug or alcohol test results and test refusals. When a driver completes the return-to-duty (RTD) process and follow-up testing plan, this information will also be recorded in the Clearinghouse.

What does this mean for BeaconInsight Customers?

Beginning January 6th, 2020, the Clearinghouse will become operational. This will impact all CDL drivers who operate commercial motor vehicles on public roads, their employers, and service agents. It will also impact the DQ file. A pre-employment full query as well as an annual limited query (or full) will be required in the DQ file. Currently the Clearinghouse is not offering integration ability with any DQ file management system to manage these documents. Consent forms for both the full query and limited queries are required each time the employer wishes to run a query. The full query consent form is provided electronically within the clearinghouse. The limited query consent form is not held within the clearinghouse and will need to be maintained elsewhere. The Clearinghouse has provided a Sample Limited Consent Form that can be adapted.
